6 6. Client Obligations

In addition to the obligations set out elsewhere in this Agreement, the Client agrees to:

  • Provide true, accurate, and up-to-date information and promptly notify the Company of any changes;
  • Keep all login credentials secure and not share them with third parties;
  • Comply with all applicable laws, regulations, and the terms of this Agreement and the Regulatory Documents;
  • Ensure that any funds deposited into the Account are lawfully obtained and not subject to any third-party claims;
  • Cooperate with any KYC, AML, or security verification requests made by the Company;
  • Bear full responsibility for all trading decisions and outcomes, understanding the risks described in the Risk Disclosure.

7 7. Prohibited Conduct

The Client shall not, directly or indirectly:

  • Use the Platform for any unlawful purpose or in violation of this Agreement;
  • Engage in market manipulation, insider trading, price manipulation, wash trading, or any activity that abuses, exploits, or attempts to defraud the Platform or other Clients;
  • Attempt to gain unauthorized access to the Platform, its systems, or other users’ accounts;
  • Introduce viruses, malware, or any code designed to disrupt, damage, or interfere with the Platform;
  • Use automated tools, bots, or scripts in a manner that violates our Rules of Trading Operations or is intended to gain an unfair advantage;
  • Misrepresent your identity, provide false documentation, or use another person’s identity to open an Account;
  • Reverse engineer, decompile, or copy any part of the Platform or its proprietary technology.

The Company reserves the right to investigate suspected violations and to take any action permitted by this Agreement or by law, including closing accounts, voiding trades, and reporting suspicious activity to relevant authorities.

8 8. Fees & Charges

The Company may charge fees in connection with the Services, including transaction fees, deposit or withdrawal processing fees, inactivity fees, or other charges described in the Regulatory Documents or displayed on the Platform. Any applicable fees are disclosed to the Client before a transaction is completed.

The Company may, at its discretion, waive or modify fees at any time. Unless otherwise stated, all fees are deducted from the Client’s Trading Balance or from the transaction amount, as applicable.

9 9. Intellectual Property

All content on the Platform, including software, design, text, graphics, logos, trademarks, charts, data feeds, and all other materials, is the property of the Company or its licensors and is protected by applicable intellectual property laws.

The Client is granted a limited, non-exclusive, non-transferable, revocable license to use the Platform solely for the purpose of using the Services in accordance with this Agreement. No other rights are granted, and the Client may not reproduce, distribute, modify, or create derivative works from any Platform content without our prior written consent.

10 10. Disclaimer of Warranties

The Services and Platform are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

The Company does not warrant that the Platform will be uninterrupted, error-free, or free of harmful components, or that market data and quotes will be accurate, complete, or timely. Trading involves significant risk of loss, as further described in the Risk Disclosure, and the Company makes no warranty or guarantee of profit or of the performance of any trade.

11 11. Limitation of Liability

To the maximum extent permitted by law, the Company, its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or trading losses, arising out of or in connection with the use of, or inability to use, the Services, even if advised of the possibility of such damages.

To the maximum extent permitted by law, the aggregate liability of the Company for all claims arising out of or relating to this Agreement or the Services shall not exceed the total amount of fees paid by the Client to the Company in the twelve (12) months preceding the claim, or the Client’s Trading Balance, whichever is lower.

Nothing in this Agreement limits or excludes liability that cannot be limited or excluded under applicable law.

12 12. Indemnification

The Client agrees to indemnify, defend, and hold harmless the Company and its directors, officers, employees, agents, and affiliates from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • the Client’s use of the Services;
  • any breach of this Agreement or the Regulatory Documents by the Client;
  • any violation of applicable laws or regulations by the Client; or
  • any dispute between the Client and any third party arising from the Client’s use of the Services.

13 13. Suspension & Termination

The Client may close their Account and terminate this Agreement at any time by contacting customer support, subject to any outstanding obligations. Any funds in the Account will be returned in accordance with the Non-Trading Operations Regulations and Payment Policy, less any applicable fees or charges.

The Company may suspend or terminate the Client’s Account and this Agreement, with or without notice, if we reasonably believe that the Client has breached this Agreement or the Regulatory Documents, engaged in fraudulent or abusive activity, posed a risk to the Platform or other Clients, or if continued service would violate applicable law.

Upon termination, the Client’s right to use the Services ceases immediately, and any open trades will be closed at their then-current value in accordance with the Rules of Trading Operations.

14 14. Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations under this Agreement where such failure or delay results from events beyond its reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, government actions, pandemics, power failures, internet or telecommunications outages, failure of third-party systems or market data providers, and other events of force majeure.

15 15. Governing Law & Dispute Resolution

This Agreement and any disputes arising out of or in connection with it shall be governed by and construed in accordance with the laws of the jurisdiction of the Company’s incorporation, without regard to its conflict-of-laws principles.

The parties shall first attempt to resolve any dispute amicably through good-faith negotiations and the Company’s internal complaints procedure. If the dispute cannot be resolved within sixty (60) days, either party may submit the dispute to the competent courts of the Company’s jurisdiction, unless mandatory consumer protection laws of the Client’s country of residence provide otherwise.

16 16. Amendments

The Company may amend this Agreement and the Regulatory Documents at any time. We will notify the Client of material changes by posting a notice on the Platform or by email to the registered address. Changes take effect on the date specified in the notice.

If the Client continues to use the Services after the effective date of any amendment, the Client is deemed to have accepted the amended terms. If the Client does not accept the amendments, the Client may close their Account before the changes take effect.

You should not invest more than you can afford to lose and should ensure that you fully understand the risks involved. Trading leveraged products may not be suitable for all investors. Trading non-leveraged products such as stocks also involves risk as the value of a stock can fall as well as rise, which could mean getting back less than you originally put in.
